“2016 BIRDING COLOMBIA SWEEPSTAKES”

OFFICIAL RULES AND REGULATIONS

ELIGIBILITY: The “2016 Birding Colombia Sweepstakes” (“Sweepstakes”) is open to legal residents United States and the District of Columbia who are 18 years of age or older at the time of entry (“Entrants”). Employees, officers, and directors of National Audubon Society, Inc. (“Audubon”), Conservation Strategy Fund, University of the Andes  (Universidad de los Andes), Manakin Nature Tours Colombia and any and all entities directly associated with the Sweepstakes, including immediate family members and members of the same household, are not eligible to participate (collectively with Audubon, the “Sweepstakes Entities”). Void where prohibited by law. Sweepstakes is governed by U.S. law and subject to all applicable federal, state and local laws and regulations. By entering the Sweepstakes, entrants agree to accept and be bound by all terms of these Official Rules and Regulations (“Official Rules”).

HOW TO ENTER: To enter the Sweepstakes, Entrants must complete the Survey located here some time from 12:00:01 a.m. Eastern Time (“ET”) on February 27, 2016 through 11:59:59 p.m. ET on March 19, 2016 (the “Entry Period”). All eligible Entrants who complete the Survey during the Entry Period will be entered into the drawing for the Grand Prize (the “Drawing”).  Only one (1) entry permitted per person. Audubon reserves the right in its sole discretion to disqualify and remove from the Drawing any Entrant at any time, including for false or deceptive acts. An Entrant may also be disqualified if the Entrant has not otherwise complied with any portion of these Official Rules. The odds of winning depend on the number of entries received.

RANDOM DRAWING: One (1) Grand Prize Winner will be selected by a random drawing conducted by U.S. Sweepstakes Fulfillment Co. on or around March 28, 2016, from among all eligible entries received during the Entry Period. The Winner will be contacted by email within seven (7) days of the drawing date.

PRIZE: Grand Prize: One (1) Grand Prize will be awarded of a trip for the winner and one (1) guest to Bogota, Colombia. Grand Prize includes the following:

  • Round-trip coach airfare for winner and one (1) guest on Avianca from one of the following gateway airports: Los Angeles (LAX), Miami (MIA), New York (JFK), Orlando (NCO), San Francisco (SFO), and Washington, DC (IAD)..  Winner and guest will be responsible for transportation to/from the gateway airport;
  • Guided birding field trips during a 4-day/3-night stay in Bogota, provided by Manakin Nature Tours Colombia;
  • 3-nights double-occupancy accommodations. Lodging to be determined by Manakin Nature Tours Colombia in its sole discretion; and
  • All meals (breakfast, lunch, dinner) during the 4-day/3-night trip to be provided by Manakin Nature Tours Colombia.

Trip is subject to availability. Winner and guest must travel on the same itinerary. Trip must be booked no later than 30 days prior to departure, and before April 1, 2017. Blackout dates, advance booking requirements, and travel restrictions may apply. Availability is subject to factors such as weather, seasonality and space availability. Reservations are subject to availability. If weather affects the ability for winner and his/her guest to redeem any portion of prize during the scheduled date and time, then Audubon shall have no further obligation to the winner and/or guest other than to supply the remaining elements of the prize package minus the unused portion of prize. If for any reason whatsoever, winner and/or guests are unable to travel after all travel arrangements have been made and paid, Audubon shall have no further obligation to the winner. All other expenses, including, but not limited to, transportation to/from the gateway airport, ground transportation to/from airport, baggage fees, accident or cancellation insurance, gratuities, items of a personal nature, alcoholic beverages, telephone and all other charges or costs associated with the use of the prize, and any documentation required for travel, are the sole responsibility of the winner to pay. In the event the winner or his/her guest engages in behavior that, as determined by the Audubon and in their sole discretion, is obnoxious or threatening, illegal, or that is intended to annoy, abuse, threaten or harass any other person, Audubon reserves the right to terminate the trip prize in whole or in part, with no further compensation.

The Approximate Retail Value (“ARV”) of the Grand Prize is $3,500.

No substitution or transfer of prizes or cash redemptions permitted, except at Audubon’s sole discretion. Audubon reserves the right to substitute for any reason whatsoever a prize (or portion thereof) of comparable or greater value, at its sole discretion. Winners are responsible for the reporting and payment of all taxes as well as any other costs and expenses associated with acceptance and use of their prize not specified herein as being awarded.

Voucher is not redeemable for cash and will not be replaced if lost or stolen. Voucher usage is subject to the issuing company’s complete terms and conditions, including expiration dates.

PRIZE CONDITIONS: The Grand Prize Winner will be required to sign an Affidavit of Eligibility and Release of Liability and Publicity (the “Releases”) (where allowable) and return same, properly executed, within seven (7) days of issuance of prize notification. Releases will require the winner to furnish his/her Social Security Number for the sole purpose of tax reporting, as required by law. If a winner is otherwise eligible under these Official Rules, but is nevertheless deemed a minor in his or her state of primary residence, his/her prize will be awarded in the name of his/her parent or legal guardian who must execute the Releases on the minor winner’s behalf. The Grand Prize Winner will be notified by phone or e-mail, and confirmed via US Mail or other form of home delivery on or about March 28, 2016. Noncompliance with this time period or failure of a potential winner to respond to a notification attempt may result in disqualification and, at Audubon’s sole discretion, an alternate winner may be selected. If: (i) any prize or prize notification is returned as undeliverable; (ii) a potential winner declines his or her prize; or (iii) a potential winner fails to comply with any of the Official Rules as outlined herein, such potential winner will be disqualified and an alternate winner may be selected by random drawing. Winner’s guest must be a legal U.S. resident, 18 years or older and must complete and return a Travel Companion Liability Release, or if winner’s guest is deemed a minor in his or her state of primary residence, Grand Prize winner must be minor guest’s parent or legal guardian and must execute the Travel Companion Liability Release on the minor guest’s behalf.

By entering this Sweepstakes and/or accepting the prize, Entrants and the Grand Prize Winner agree to, and hereby do, release Audubon, Conservation Strategy Fund, University of the Andes (Universidad de los Andes), Manakin Nature Tours Colombia, and their directors, employees, officers and agents from any and all liability, loss or damage arising from or in connection with participation or attempt to participate in the Sweepstakes and/or the awarding, receipt, use or misuse of the prize or participation in any prize related activities, and claims based on publicity rights, defamation or invasion of privacy. Audubon, and its directors, officers, employees, attorneys, representatives and agents make no warranties, and hereby disclaim all warranties, express or implied, concerning any prize furnished or awarded in connection with the Sweepstakes, including, but not limited to, any winner’s ability to claim a prize awarded in the Sweepstakes for reasons of the prize provider’s bankruptcy, insolvency or failure to continue its business. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, SUCH PRIZES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, AND AUDUBON HEREBY DISCLAIMS ALL SUCH WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND/OR NONINFRINGEMENT.

PRIVACY: Personal information collected from online entrants is subject to Audubon’s Privacy Policy, which can be found at http://www.audubon.org/privacy-policy; provided, that in the event of any conflict between these Official Rules and such Privacy Policy, the terms and conditions of these Official Rules shall prevail.

WINNER CONFIRMATION: You may obtain the name/city of residence of the winners by mailing a self-addressed stamped envelope to: 2016 Birding Colombia Sweepstakes – Winner’s List, P.O. Box 25466, Rochester, NY 14625. Requests received after April 14, 2016 will not be honored.

GENERAL CONDITIONS: Audubon is not responsible for misdirected, incomplete, lost, late, undelivered, inaccurate, illegible, or delayed entries, nor for technical, hardware, or software failures of any kind, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmissions or other errors or problems which may limit or affect a person’s ability to participate in the Sweepstakes, whether human, mechanical, typographical, printing, electronic, network or otherwise, relating to or in connection with the Sweepstakes, including, without limitation, errors which may occur in connection with the administration of the Sweepstakes, the announcement of the prize or in any Sweepstakes-related materials. In the event of sabotage, acts of God, terrorism or threats thereof, computer virus or other events or causes beyond Audubon’s control, which corrupt the integrity, administration, security or proper operation of the Sweepstakes, Audubon reserves the right, in its sole discretion, to modify, cancel or suspend the Sweepstakes. In the event of cancellation, Audubon reserves the right to select the Grand Prize winner from among all eligible, non-suspect submissions received prior to the event requiring such cancellation using the winner selection procedure outlined herein. Each Entrant hereby acknowledges and agrees that the relationship between Entrant and Audubon is not a confidential, fiduciary, or other special relationship, and that Entrant’s decision to submit his/her submission to Audubon for purposes of the Sweepstakes does not place Audubon in a position that is any different from the position held by members of the general public with regard to elements of Entrant’s submission. By entering this Sweepstakes, Entrant acknowledges and agrees that Audubon and its designees have the right, unless prohibited by law, to use Entrant’s name, city and state of residence, voice, picture and likeness, without compensation, notification or approval, for the purpose of advertising and publicizing Audubon and all matters related to the Sweepstakes, in any manner or medium, now or hereafter known, throughout the world in perpetuity.
